What to Do If You Are Arrested
If you are arrested or are under investigation for a crime, there are several important things to keep in mind to protect yourself and your rights:
- You Have the Right to Remain Silent: Other than identifying yourself, you do not need to speak to law enforcement officers or prosecutors without an attorney present. In fact, it is in your best interests to avoid saying anything at all, other than that you will not be speaking and wish to have a lawyer present. Many people accidentally incriminate themselves or say things that can later be twisted by law enforcement and/or prosecutors during criminal proceedings. You should remain silent during the arrest and in any future interactions with law enforcement or investigators if you do not have an attorney with you.
- You Do Not Have to Consent to a Search: If law enforcement does not have a search warrant, you do not have to consent to a search of your belongings, home, vehicle, etc. Note that police officers may search your person (e.g. conduct a “pat-down”) if they suspect you have a weapon. However, you do not have to allow a police officer into your home or permit them to look through your vehicle or belongings without a warrant.
- You Have the Right to an Attorney: If you are arrested or charged with a crime, or if you are simply under investigation, you have the right to hire a criminal defense attorney. If you cannot afford an attorney, you have the right to be appointed one. Not only do you have the right to an attorney, but it is also in your best interests to work with one as soon as possible.
