Florida’s Definition of “Wrongful Death”
In Florida, a death is considered “wrongful” if it resulted from negligence, wrongful (unlawful) conduct, default, or breach of contract. Generally speaking, this means that if the decedent (the deceased) had lived and would have had grounds for a personal injury claim, the death is classified as “wrongful.”

Who Is Allowed to File a Wrongful Death Claim?
In Florida, the personal representative of the decedent’s estate must be the one to file the wrongful death claim. Although family members who are not the personal representative cannot bring the claim themselves, damages are typically sought on their behalf.
Who Can Recover Wrongful Death Damages in Florida?
As previously mentioned, the personal representative of the decedent’s estate brings the claim on behalf of certain eligible family members.
These family members include:
- The surviving spouse
- Any surviving child/children
- The surviving parent(s)
- Any blood relative or adoptive sibling who was dependent on the decedent in life
Additionally, when the personal representative brings a wrongful death claim, they also typically seek damages on behalf of the estate itself. This simply means that the estate can recover compensation for certain payments it made in relation to the wrongful death.
What Damages Are Available in Wrongful Death Cases?
Both the estate and eligible surviving family members (as outlined above) may recover compensation for certain damages through a wrongful death claim.
