How Florida Car Accident Claims Work
Florida is what is known as a “no-fault” state. This means that all licensed drivers are required to carry $10,000 in personal injury protection (PIP) insurance in addition to their minimum liability coverage. Ostensibly, the purpose of PIP is to allow car accident victims to recover compensation for certain damages more quickly and more efficiently than they would be able to through a standard personal injury claim. However, PIP also comes with certain limitations.

Understanding Florida’s No-Fault Laws
Because Florida is a no-fault state, all licensed drivers are required to have $10,000 in personal injury protection (PIP) coverage in addition to minimum liability coverage. After an accident, your PIP insurance covers you for certain damages, regardless of fault. This means that you do not have to prove that the other driver was negligent, reckless, or in any way to blame for the accident. However, PIP coverage is limited, and you will not be able to recover compensation for all of your damages.
In Florida, PIP insurance covers the following:
- Up to 80% of “approved” medical services
- Up to 60% of lost wages up to a $10,000 limit
- Death benefits (funeral/burial costs) up to $5,000
PIP does not cover the full cost of your medical expenses, nor does it cover all medical services. For example, acupuncture is not covered by PIP. Additionally, if your injury does not warrant emergency attention, you may only be covered up to $2,500 through PIP.

How to File a Car Accident Claim in Jacksonville
Florida is what is known as a “no-fault state.” This means that it operates under a no-fault system in which those injured in motor vehicle accidents must typically turn to their own insurance providers—rather than the insurance providers of the at-fault drivers—for compensation. Under this system, you are required to carry personal injury protection, or PIP, insurance. PIP coverage is available regardless of fault, meaning you can still be compensated for your damages even if you were partly, mostly, or completely at fault for the accident.

What Florida’s No-Fault Laws Mean for Your Claim
When it comes to motor vehicle accidents, some states follow fault-based systems and others adhere to no-fault rules. Both systems affect how the claims process works, as well as what compensation is available in a typical car accident case.
