Traumatic Brain Injury (TBI) vs. Acquired Brain Injury (ABI)
A traumatic brain injury, or TBI, is the result of trauma to the head and skull, such as from a car accident; slip and fall; or falling scaffolding, tile, or other debris. This is different from a non-traumatic brain injury, also known as an acquired brain injury (ABI), which is linked to stroke, near-drowning, exposure to toxins, a lack of oxygen, or other internal issues. ABIs can be the result of medical malpractice or an accident occurring in a neglected work environment or commercial property.
Determining Liability in Brain Injury Claims
While the seriousness of your injury is just one factor in determining what damages you may seek and how much compensation may ultimately be awarded, there are a few other issues that come into play in any claim for compensation. Liability for your accident may fall on different people, such as a property owner, if you slipped and fell in a dangerous or neglected property; a manufacturer, if your brain injury resulted from a defective product; or a doctor if your brain injury resulted from medical malpractice.
